TERMS AND CONDITIONS

Price, specification, and terms are subject to change without notice. Creative Energy Technologies Inc, is not responsible for errors in typography and/or photography. All parts come with original manufacturer warranty and technical support is handled by the respective manufacturers. Customer pays return shipping on all services. Creative Energy Technologies Inc reserves the right to refuse service to anyone.

Creative Energy Technologies Inc accepts the following Payment Methods:

Purchases with credit cards need to
have the billing address of the credit card (the address that the
credit card statement is mailed to). This information would go in
the "bill to" section of the credit card. Missing or incorrect card
information and expiration dates will delay the processing of your
order. If the credit card declines payment, your order will not be
processed. Some credit cards and debit cards have daily caps and
the total purchase needs to be broken down over several entries.
That is not a problem, just inform us of what the daily maximum
amount is in the comments section of the online form so your order
can be processed in a timely matter.
Prepaid Company Check, Personal Check, Cashier Check or Money Order
(Note: All Prepaid Orders will take longer to process due to all checks must be cleared, including Cashier's Check due to the existence of fraudulent checks.)
Purchase Orders (must be approved by credit department and verified)
No COD order
Creative Energy Technologies, Inc will only accept international
credit card orders if the following terms are met:
Faxed letter stating what you are wishing to purchase and accepting
all customs and duties related to the purchase. Stating on the
faxed letter the acceptance of zero refund if you refuse the
package at customs. Giving the three digits on the back of the
credit card for security measures. Accepting in writing that
Creative Energy Technologies will verify that the credit card given
is not stolen and is owned by the person listed on the bill to
address given on the online order. Signed and printed name on the
fax letter and fax to 1-518-287-1459.
International orders may be paid by wire transfer or bank check.

Returns/Restocking Fee/Additional fees
Merchandise purchased through the Creative Energy Technologies Inc may be returned within 30 days of receipt for a refund or a credit towards your account only if in new and unopened/unused condition.

Any gas appliance or water system that has been installed cannot be returned.

All returns must be expressly authorized by Creative Energy Technologies, Inc. within 30 days of order placement.

We will accept for return, with in 30 days of order receipt, only new, standard stock, non-defective, unused, in warranty and originally packaged products for full credit.

Any returns received under 30 days that are returned used, have missing packaging, missing parts and instructions or cannot be re-sold as new will be assessed with a 20% re-stocking fee and store credit will be issued to your account for future use.

Solar pool heaters receive a 20% restocking fee from the manufacturer. These fees negate any terms we have agreed to in regards to a full refund less shipping.

Any returns received after 30 days will receive store credit. If item is returned used, have missing packaging, missing parts and instructions or cannot be re-sold as new will be assessed with a 20% re-stocking fee deducted from store credit issued.

ALL DAMAGE CLAIMS AND MISSING PARTS MUST BE
REPORTED WITHIN 48 HOURS OF RECEIPT OR CLAIMS WILL NOT BE HONORED.

Shipping charges will not be refunded, unless an error was made by the Creative Energy Technologies Inc in shipping. Before returning an item, you must have an RMA number. Please call or email us to get an RMA #. Shipping charges are non-refundable.

To return a product to Creative Energy Technologies Inc, you must obtain a Return Merchandise Authorization ("RMA") number within 30 days. Creative Energy Technologies Inc will not accept returns without prior authorization and a RMA number. Once issued, RMA numbers are valid for 15 days within which return products must be received by the Creative Energy Technologies Inc. RMA numbers will not be extended or reissued. Customer should prominently display the RMA number(s) on the shipping label of boxes containing the returned product.
Customer is solely responsible for shipping any returned product to Creative Energy Technologies Inc. Customer agrees to use only reputable carriers capable of providing proof of delivery and insurance for the entire value of the shipment. Customer agrees to bear all shipping charges and all risk of loss for the return product during shipment. Customer agrees that all returned products will be 100% complete, in re-saleable condition, and will include the original packaging material, manuals, blank warranty cards, and other accessories provided by the manufacturer. If any component of the returned product is missing, Creative Energy Technologies Inc's Return Procedure will be breached and the Creative Energy Technologies Inc will reject the entire return or may choose to impose additional charges against the customer for replacement of the missing component.
Creative Energy Technologies Inc will not refund to Customer the original shipping charges. In addition, Creative Energy Technologies Inc reserves the right to charge a restocking fee on end of life and special order products.

Refused or Undeliverable Packages and Shipments
Sometimes, a carrier will be unable to deliver a package to the address provided to them. This can happen if the address provided is incorrect, or if the person receiving that shipment at that address refuses it. If this happens, the package will

Be returned to Creative Energy Technologies Inc's. We will provide a refund to the buyer for the item, less a 20% restocking fee and the shipping charges incurred by Creative Energy Technologies Inc's (The cost of shipping the package to you and back to us) or
The customer will provide a new shipping address and we will reconsign the order. The additional shipping cost due to the reconsignment will be billed to the customer.
This policy applies to all products, including items that are featured with free shipping promotions.

Processing Time
You can expect your order to be processed within approximately one to two "business" days, provided the items are in stock and there are no problems with the payment verification. Creative Energy Technologies Inc does not guarantee same day shipping. Orders will not be processed on weekends and holidays. Creative Energy Technologies store hours are M-F, 9-5pm EST. Orders are processed during store hours. Orders with standard shipping depart usually with in 48 hours. Orders will be received by the consumer using standard shipping, within 7 – 10 business days. Excluding weekends, early closures and holidays.

Back Orders
Any items that are unavailable will be placed on back order.
You will be contacted of the back order status via email. We try to ship
complete to keep shipping costs down. Additional shipping costs will be added to your order when split shipping.

Order Status
Creative Energy Technologies Inc will do everything possible to keep you informed of your order via e-mail. Your tracking number will be emailed to you once the item is shipped. To ensure your Sales Receipt and tracking number email is not swept up by an over-zealous SPAM filter,

You may request a cancellation of your order, provided your order has not already been processed and shipped. Please call during our business hour to cancel your order. If your account has already been charged, you will receive a credit back to your account within approx. 1-2 business days.

Creative Energy Technologies Inc Agreement

By accepting delivery of any product delivered from Creative Energy Technologies Inc, you ("Customer") agree to be bound by the terms and conditions listed below. You and Creative Energy Technologies Inc agree that the following terms and conditions are the exclusive terms governing the sales transaction between Customer and Creative Energy Technologies Inc. Any attempt to alter, supplement, modify or amend these terms and conditions by the Customer will be considered a material alteration of this agreement and, therefore, are null and void. In addition, these terms and conditions are subject to change at any time, without prior written notice. Therefore, please check these terms and conditions carefully each time you place an order with or accept delivery of any goods from Creative Energy Technologies Inc.

1. WARRANTIES

Creative Energy Technologies Inc is a dealer/distributor only. Products sold by the Creative Energy Technologies Inc are not manufactured by Creative Energy Technologies Inc. The products may, however, be covered by each manufacturer's warranty, service, and support policy (if any). Creative Energy Technologies Inc assigns and passes through to the Customer any warranty of the manufacturer, and Customer acknowledges that it shall have recourse only under such warranties and only as against the manufacturer of the products. Creative Energy Technologies Inc MAKES NO REPRESENTATION OR EXPRESS WARRANTY WITH RESPECT TO THE PRODUCT EXCEPT THOSE STATED IN THIS DOCUMENT. Creative Energy Technologies Inc DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, AS TO ANY SUCH PRODUCT, INCLUDING AND WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY IMPLIED WARRANTIES ARISING FROM STATUTE, TRADE USAGE, COURSE OF DEALING, OR COURSE OF PERFORMANCE.

2. LIMITATION OF LIABILITY

IN ALL CIRCUMSTANCES CREATIVE ENERGY TECHNOLOGIES INC'S MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. Creative Energy Technologies Inc SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. Creative Energy Technologies Inc SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT CREATIVE ENERGY TECHNOLOGIES INC IS APPRISED OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.

3. GENERAL TERMS AND CONDITIONS

Payment Terms Orders: An order is not binding upon Creative Energy Technologies Inc until it is accepted; Creative Energy Technologies Inc must receive payment before it will accept an order. Payment for product(s) ordered is due prior to shipment. Customer can make payment by credit card, or some other method prearranged with Alternative Energy Store . You agree to pay the amount(s) due as specified on the invoice, and you agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater.

Shipping Charges: Your total cost for purchase of any product will include shipping and handling charges shown on the Creative Energy Technologies Inc invoice.

Title & Risk of Loss: Creative Energy Technologies Inc will arrange for shipment of ordered product(s) to the Customer, Free On Board (F.O.B.) shipping point, meaning title to the product(s) and risk of loss passes to the Customer upon delivery to the carrier. Creative Energy Technologies Inc reserves a purchase money security interest in the product(s) until its receipt of the full amount due. Customer agrees to allow Creative Energy Technologies Inc to sign appropriate documents on Customer's behalf to permit Creative Energy Technologies Inc to protect its purchase money security interest. Creative Energy Technologies Inc will advise Customer of estimated shipping dates, but Creative Energy Technologies Inc will, under no circumstances, be responsible for delays in delivery, and associated damages, due to events beyond its reasonable control, including without limitation, acts of God or public enemy, acts of federal, state or local government, fire, floods, civil disobedience, strikes, lockouts, and freight embargoes.

Governing Law and Jurisdiction: Any dispute arising out of or related to these Terms and Conditions or the sales transaction between Creative Energy Technologies Inc and Customer shall be governed by the laws of the State of New York, without regard to its conflicts of law rules. Specifically, the validity, interpretation, and performance of this agreement shall not be governed by the United Nations Convention on the International Sale of Goods. Creative Energy Technologies Inc and Customer consent to the exclusive jurisdiction and the venue of the State Courts of the State of New York, Schoharie County, to resolve any dispute between them related hereto, and the parities waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agree not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against Creative Energy Technologies Inc that is more than one year after the date of the applicable invoice.

Severability: If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable New York law.

Waiver: The failure of either party to require performance by the other party of any provision of this agreement shall not affect in any way the first party's right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in this agreement shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing.

Entire Agreement: These terms and conditions, together with the Creative Energy Technologies Inc's invoice respecting the products ordered by Customer, are the complete and exclusive agreement between Creative Energy Technologies Inc and Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between Creative Energy Technologies Inc and Customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.

Illegal Activity, Fraud or Non-Payment for Merchandise:

In the event of any illegal activity on the Creative Energy Technologies Inc's, we reserve the right to turn over the information collected to the appropriate authorities, lawyers and credit collection personnel. This includes attempts to hack into or otherwise compromise Creative Energy Technologies Inc's. Also included is any fraudulent use of credit cards, checks, money orders or wire transfers.

Creative Energy Technologies Inc's reserves the right to use all legal means to recover payment for any orders shipped. This includes non-payment as a result of credit card chargebacks or disputes, and checks with insufficient funds or stop payment.
